Terms and conditions

Below are the terms and conditions that constitute the agreement between you as a registered mystery shopper and School of Retail Pty Ltd (T/A School of Retail).  You must read, understand and agree to all the following terms and conditions before you become a registered Mystery Shopper for School of Retail.  By clicking agree, the terms and outlined details below become a legally binding agreement between you and School of Retail.

Due to the outbreak of the novel Coronavirus (COVID-19), by agreeing to be a Mystery Shopper with School of Retail Pty Ltd, you agree to the following before accepting and/or completing any Mystery Shopping jobs:

  • You are NOT experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell;
  • You have NOT travelled internationally within the last 14 days;
  • You affirm that you, as well as all your household members, have not been diagnosed with COVID-19 WITHIN THE PAST 30 DAYS;
  • You affirm that you, as well as all your household members, have not knowingly been exposed to anyone diagnosed with COVID-19 WITHIN THE PAST 30 DAYS;
  • You affirm that you will NOT accept or complete any Mystery Shopping jobs if you are sick and display any of the aforementioned symptoms;
  • You affirm that you will CANCEL any jobs that you accept if you suddenly feel sick and display any of the aforementioned symptoms and will not attempt to complete them;
  • You understand and agree that School of Retail Pty Ltd cannot be held liable for any exposure to the COVID-19 virus as a result of any activity associated with completing a Mystery Shopping job;
  • You agree to follow the Covid-19 safe plan/steps outlined in any communication to you from School of Retail Pty Ltd; and
  • By accepting below, you agree to each statement above and release School of Retail Pty Ltd, it’s individual members, Directors and associated entities, from any and all liability for the unintentional exposure or harm due to COVID-19.

School of Retail advise you to obtain legal advice as to the nature, effect and extent of this Agreement. Your registration as a Mystery Shopper for School of Retail signifies that you are agreeing that: 

  1. When you register as a Mystery Shopper with School of Retail, School of Retail will keep your details in its database of potential mystery shoppers, in accordance with our privacy policy.
  2. You are not an employee of School of Retail, instead you are an independent contractor. You agree that you will seek relevant independent advice to suit your individual circumstances in relation to conducting Mystery Shopping jobs with the School of Retail.  
  3. As you are not an employee of School of Retail, there is no guarantee or obligation for School of Retail to provide you with regular or ongoing mystery shopping opportunities. You acknowledge that in the event of School of Retail removing you as a registered mystery shopper you will have no rights, claims or remedies against School of Retail in respect of such removal.
  4. You may not be required to provide us with an ABN.  Please seek independent tax advice for further details relating to your individual circumstances. 
  5. Once you have accepted a mystery shopping job, you automatically agree to complete it within the required timeframe.  If you are unable to do so, you must immediately notify School of Retail in order for School of Retail to make alternative arrangements to have the job completed.
  6. Completing the mystery shopping job includes completing the required survey, in full and to the satisfaction of School of Retail.  Payment will only be made once the survey response has been approved by School of Retail.
  7. You understand that School of Retail will only notify you of potential mystery shopping opportunities that it believes you are suitable for and that the same assignment may be notified to a variety of other people. 
  8. Mystery shopping jobs are allocated on a first user to accept basis.
  9. To avoid any conflict of interest, you will only accept jobs that are:
    • For brands that you are not a current employee of; 
    • At stores where you are not a friend or relation of an employee; 
    • At stores where you have not accepted a previous mystery shopping job in the preceding 2-month period. 
  10. School of Retail does not guarantee to notify you of any mystery shopping assignments. This may be because no suitable opportunities are available in your area, or for any other reason. 
  11. Whether you are chosen to register for and participate in a mystery shopping assignment is at the sole discretion of School of Retail based on key criteria which may or may not be requested by the brand. School of Retail may choose an alternative mystery shopper to participate in a mystery shopping assignment instead of you (and School of Retail is not obliged to provide any particular reason for doing so). 
  12. If School of Retail incurs any cost, loss, expense, liability or damage which is related to you being a Mystery Shopper or your participation in a mystery shopper assignment or this agreement (no matter how distantly related), then you agree to immediately pay to School of Retail the full amount of that cost, loss, expense, liability or damage as determined by School of Retail. 
  13. You agree not to disclose the details of the mystery shop and all information you provide as part of the survey to any party other than School of Retail and/or requested by law.
  14. Once you have completed the survey, all comments and feedback provided becomes the sole intellectual property of School of Retail and the relevant brand. Any comments or materials sent to School of Retail including application, feedback or review data, such as questions, comments, suggestions, or the like (collectively “Feedback”), is deemed to be the property of School of Retail and School of Retail is free to reproduce, use, disclose and distribute the information to others without limitation subject to any applicable privacy policy published by School of Retail from time to time.
  15. If you discover or receive any information about School of Retail, or the brands we work with, which is not generally known to the wider public you must keep that information secret unless School of Retail gives you specific written authorisation to disclose it. You must not use or profit from any such information you discover or receive unless School of Retail gives you written authorisation allowing you to do so.
  16. You agree to keep confidential the details of all surveys provided to you, as these constitute the intellectual property of School of Retail.
  17. You agree that any information you supply to School of Retail in relation to a mystery shopping assignment or a potential mystery shopping assignment or via the registration to be a Mystery Shopper is true and correct and you agree to inform School of Retail of any changes to that information. 
  18. Independent Contractor
    • You agree to supply at your own cost any equipment or transport necessary for performing a mystery shopping assignment (unless otherwise advised).
    • When you are performing a mystery shopper assignment, you are performing the assignment as someone who has independently contracted to perform a discrete service for School of Retail not as an employee of School of Retail. 
    • You agree that nothing in this agreement (or related to this agreement) makes you an employee of School of Retail or makes you an agent or partner of School of Retail or any of its related entities or officers. 
    • At all times, you remain independently contracted and, as such, to the extent permissible by law, School of Retail has no obligations in respect of annual leave, sick leave, long service leave, superannuation, workers’ compensation, taxes, accident, sickness and life insurance for yourself.
    • School of Retail has no responsibility to pay you or anyone associated with you for any of these things. Likewise, to the extent permissible by law, School of Retail has no responsibility to pay you or on your behalf wages, superannuation or any other contributions that employers pay including (amongst other things) payroll tax and workers’ compensation premiums.
    • You do not have any authority to agree to anything on School of Retail’s behalf or to bind School of Retail to any agreement or arrangement or understanding. You are not entitled to act as an agent or employee of School of Retail and must not do anything which would lead any reasonable person to think the contrary. 
  19. Limitation of Liability
    • You are a Mystery Shopper at your own risk and you participate in any mystery shopping jobs entirely at your own risk.
    • When you are participating in a mystery shopping job (and at all other times) you, and not School of Retail, are completely responsible for yourself and anything that happens to you. 
  20. When these terms and conditions mention “School of Retail” they mean School of Retail as well as any of its employees, officers, contractors and related bodies corporate (as that term is defined in the Corporations Law). 
  21. These terms and conditions are governed by the law in force in Victoria. 
  22. No variation, modification or alteration of any of the terms of the Agreement shall be of any effect unless in writing and signed by each of the parties. 
  23. If any provision of the Agreement is deemed to be, invalid, unlawful or unenforceable in any respect, such invalidity, illegality or unenforceability will not affect any other provisions of this Agreement or any other instrument. 
  24. This Agreement is the entire agreement and understanding between the parties on everything connected with the subject matter of this Agreement. It supersedes and substitutes any prior agreement or understanding on anything connected with that subject matter.
